Church Chatter – Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Church Chatter, including our websites, mobile applications, and related services (collectively, the “Services”).

Church Chatter is a platform and brand owned and operated by ChurchMe LLC (“ChurchMe,” “we,” “our,” or “us”).

By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services unless use is supervised or authorized by a parent, guardian, church, or organization in accordance with applicable law.

By using the Services, you represent that you are legally permitted to do so.

3. Accounts

You are responsible for:

  • Maintaining account security

  • Protecting login credentials

  • All activity occurring under your account

  • Providing accurate information

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Church Communities & Organizations

Churches, organizations, and administrators using the Services are responsible for:

  • Content they upload or manage

  • Communications sent through the platform

  • Obtaining permissions and consents from members

  • Compliance with applicable laws

  • Moderation and management of their communities

ChurchMe LLC acts as a platform provider and is not responsible for church-managed content or communications.

5. Acceptable Use

You agree not to:

  • Violate laws or regulations

  • Harass, threaten, or abuse others

  • Upload unlawful, defamatory, hateful, or obscene content

  • Impersonate another person or organization

  • Interfere with platform operations

  • Attempt unauthorized access

  • Distribute spam, malware, or phishing content

  • Infringe intellectual property rights

  • Use the Services for fraudulent activity

We reserve the right to remove content or restrict access at our discretion.

6. User Content

Users retain ownership of content they submit to the Services.

By submitting content, you grant ChurchMe LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and distribute such content solely for the purpose of operating, improving, and providing the Services.

You represent that you have the rights necessary to submit such content.

7. Giving, Payments & Fees

  • 7.1 The receiving organization, not Church Chatter, is the recipient. Church Chatter is a technology provider. Donations and payments made through the platform are intended for, and are settled to, the church or organization you select—not to ChurchMe LLC. For each payment, the receiving organization is designated to Stripe as the settlement merchant: its name appears on the donor’s card or bank statement, and the payment settles in its country and currency. ChurchMe LLC is not a charitable organization and does not solicit donations on its own behalf.

  • 7.2 How funds move. Payments are processed by Stripe, Inc. through Stripe Connect. A payment is created on ChurchMe LLC’s Stripe account and the funds are transferred to the receiving organization’s own Stripe connected account, less the fees described below, at the time the payment is captured. ChurchMe LLC does not hold or pool donated funds, does not direct them to any party other than the organization the donor selected, and does not lend, invest, or otherwise use them. Because payments are created on ChurchMe LLC’s Stripe account, ChurchMe LLC’s balance is debited for Stripe’s processing fees and for any refunds or chargebacks, which may be recovered from the receiving organization as described in 7.10 and 7.11.

  • 7.3 Stripe account requirements. Each organization accepting payments must complete Stripe onboarding and is bound directly by the Stripe Connected Account Agreement. Card details are collected and stored by Stripe; ChurchMe LLC does not receive or store full payment card numbers. We retain limited transaction records such as amount, currency, status, payment method type, fee amounts, and associated donor and organization identifiers. Stripe’s privacy policy is available at stripe.com/privacy.

  • 7.4 Fees, and who pays them. Two separate fees apply to each transaction:

    • A Church Chatter platform fee of 0.7% of the transaction amount; and

    • Stripe’s processing fee, set by Stripe.

  • Both fees are deducted from each payment before it reaches the receiving organization. An organization receives the payment amount, less Stripe’s processing fee, less the platform fee. For example, on a US$100.00 card gift where Stripe’s fee is US$3.20, the organization receives US$96.10 and Church Chatter retains US$0.70.

  • 7.5 Stripe’s fees vary. Stripe’s processing fees depend on the receiving organization’s country, the payment method used, and the country in which the donor’s card was issued. Cards issued outside the organization’s own country cost significantly more to process, and that additional cost is borne by the receiving organization in the same way as any other processing fee. Bank transfers, where offered, are typically charged at a lower rate than cards. Stripe’s published pricing is available at stripe.com/pricing.

  • 7.6 Fee adjustments after settlement. Because a card’s issuing country is not always known before a payment is completed, the split between the organization and Church Chatter may be adjusted shortly after a transaction settles so that it matches the processing fee Stripe actually charged. These adjustments may appear in your Stripe account as a partial transfer reversal or a partial fee refund. They do not change the amount charged to the donor, and they do not increase the 0.7% platform fee.

  • 7.7 Optional fee coverage on donations. When making a donation, a donor may choose to cover the applicable fees so that the organization receives the full amount intended. Where a donor elects to do so, the amount charged to the donor is increased accordingly and is shown before payment is confirmed. If the applicable fees change once the payment method is known—for example, because the card was issued in another country—the donor is shown the revised total and must confirm it before any charge is made.

  • 7.8 Paid forms. Where an organization charges for a form submission, such as an event registration, the processing fee is added to the amount charged to the payer and is displayed as a separate line item before payment. Fee coverage is not optional on paid forms. The organization receives the amount it has set.

  • 7.9 Recurring gifts. A donor who sets up a recurring gift authorizes Church Chatter and Stripe to charge the selected payment method on the stated schedule until the gift is cancelled. Donors may cancel at any time in the app, and cancellation takes effect immediately with no further charges. If a scheduled payment fails, it may be re-attempted a limited number of times, and we may notify the donor by email. Where a gift cannot be collected, it may be suspended and the donor asked to give manually or update their payment method. Amounts already given are not affected. Bank-debit retries are subject to limits set by Stripe and the applicable bank rules.

  • 7.10 Refunds. Decisions about refunds rest with the receiving organization. Where a refund is issued, ChurchMe LLC may recover the refunded amount, together with any fees already disbursed, from the organization’s balance or future payouts. Processing fees already incurred may not be recoverable from Stripe.

  • 7.11 Disputes and chargebacks. If a donor disputes a payment with their card issuer, the disputed amount and any dispute fee are initially debited from ChurchMe LLC and may be recovered from the receiving organization’s balance or future payouts. Organizations are responsible for responding to disputes relating to payments they receive.

  • 7.12 Payouts. Payouts are made by Stripe to the organization’s connected bank account on Stripe’s schedule and are subject to Stripe’s verification, holds, and reserve requirements. ChurchMe LLC does not control payout timing and is not responsible for delays arising from Stripe’s review of an account.

  • 7.13 Tax receipts and acknowledgments. The receiving organization is solely responsible for issuing donation receipts and any acknowledgments required for tax purposes, and for determining whether a payment is tax-deductible. Church Chatter does not issue tax receipts and does not provide tax or legal advice. Transaction records available in the app are provided for convenience and are not a tax receipt.

  • 7.14 Changes to fees. Fees may change. We may change the Church Chatter platform fee by giving notice in the app or by email, and any change applies to payments processed after it takes effect. Stripe sets its own processing fees and may change them at any time; those changes are outside our control and apply automatically. Because both fees are deducted from each payment before it reaches the receiving organization, a change to either will change the amount an organization receives. Current rates for your organization’s country are shown in the app.

  • 7.15 Currency. Payments are processed in the currency configured by the receiving organization. Where a donor’s card is denominated in another currency, their issuer may apply conversion or foreign transaction charges over which we have no control.

  • 7.16 Prohibited use. Giving and payment features may not be used to process payments unrelated to the receiving organization’s legitimate activities, to route funds to third parties, or in any manner prohibited by Stripe’s Restricted Businesses list. We may suspend payment features for any organization where we reasonably suspect misuse.

8. Availability of Services

We may modify, suspend, discontinue, or update portions of the Services at any time without liability.

We do not guarantee uninterrupted or error-free operation.

9. Third-Party Services

The Services may integrate with third-party providers and services.

We are not responsible for third-party services, content, availability, or policies.

10. Termination

We reserve the right to suspend, restrict, or terminate access to the Services at any time, including for violations of these Terms.

We may remove content, communities, or accounts without notice.

11. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, ChurchMe LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

12. Limitation of Liability

To the maximum extent permitted by law, ChurchMe LLC and its affiliates, officers, employees, contractors, and partners shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Data loss

  • Service interruptions

  • Unauthorized access

  • User content

  • Church communications or actions

Our total liability shall not exceed the amount paid by you to ChurchMe LLC during the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ChurchMe LLC and its affiliates from claims, damages, liabilities, and expenses arising from:

  • Your use of the Services

  • Your content

  • Your violation of these Terms

  • Your violation of applicable laws or rights of others

14. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved in applicable courts located in Delaware unless otherwise required by law

15.AI-Generated and Automated Content Disclaimer

Certain content, messages, notifications, summaries, Bible trivia, recommendations, and communications made available through Church Chatter may be generated, assisted, or distributed using automated systems or artificial intelligence (“AI”). AI-generated content may contain errors, inaccuracies, omissions, or outdated information and may not always reflect correct theological, biblical, factual, or contextual interpretations.

Church Chatter makes no representations or warranties regarding the accuracy, reliability, completeness, or suitability of any AI-generated or automated content. All such content is provided “as is” for informational and engagement purposes only.

By using the Services, you acknowledge and agree that Church Chatter shall not be liable for any loss, damage, claim, dispute, offense, misunderstanding, or reliance arising from or related to AI-generated, automated, or algorithmically produced content, communications, or recommendations made available through the platform.

16. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted with a revised effective date.

Continued use of the Services after updates constitutes acceptance of the revised Terms.
